The K1 Fiancée Visa:
If you are not yet married and you want to be with your
fiancée fast, K 1 visa (also known as a fiancée
Visa) is quickest way to legally bring
your prospective husband or wife to the United
States. Minor children of fiancées (under 21)
can also accompany them to the United States, they
will be issued K-2 visas.
The U.S. citizen must file a petition with the USCIS on
behalf of the foreign fiancée. After the petition is
approved, the fiancée can obtain a K-1 fiancée visa.
The K-1 visa is issued at a U.S. embassy or
consulate abroad. The marriage must take place
within 90 days of the fiancée entering the United
States.
These are the requirements of the K1 visa:
You must be a U.S. Citizen (there is no comparable visa for permanent residents)
Both you and your fiancée must be legally able to marry (Both of you must be unmarried , or any previous marriages must have ended through divorce, annulment or death.
You must have actually met your fiancée in the past two years, and can demonstrate the existence of a serious relationship between you. (Photos of you and your fiancée together are required)
The marriage must take place within 90 days of fiancée entering the United States. (If the marriage does not take place within 90 days or your fiancé marries someone other than States)
A fiancée Visa is a temporary visa and after your marriage, you must file an adjustment of status petition with the USCIS if your husband/wife intends to live and work permanently in the United States. This will give him/her a conditional permanent resident card for 2 years. Then 90 days prior to the expiration of the green card you must file to remove the conditions of the residence. Approximately a year later, the fiancée is eligible for citizenship.
After arriving in the United States, your fiancée also will be eligible to apply for a work permit. You should note that USCIS might not be able to process the work permit within the 90-day time limit for your marriage to take place.
Benefits of the K1 fiancé Visa:
The K1 fiancé visa generally has a shorter waiting period compared to marriage-based immigration visa petitions
Your fiancé's children can accompany her/him to the U.S. on the K-2 dependent visa as long as they are named in the fiancé visa petition
You can apply for a work permit by filing Form I-765 and engage in employment
